Functions of the Prosecutor’s Office

   a) Prosecutor’s Office function as it is determined by Recommendation (p.1) is covered by art. 4. a. LP RM, provision according to which Prosecutor’s Office represents interests of the society and protect legal order, citizens’ rights and freedoms. It can issue executory instructions to make more efficient combating and preventing criminality (art.11 p.2. b. LP RM).

   b) Prosecutor’s Office of the Republic of Moldova decides over to file or to continue penal prosecution (art.4 b, 11 p.2 a, 12 LP RM). Prosecutor’s Office represents prosecution in courts (art.4 c, 12 LP RM)  and can even challenge court’s ruling(art. 7 LP RM). In this way moldavian law demonstrates to be compatible with p.3 of the Recommendation.

   c) Prosecutor’s Office carries on penal prosecution (art. 11 p.1 LP RM) , ensures with assistance and protection the injured parties, witnesses and their families (art. 11 p.2. d LP RM). Prosecutor’s Office carries out control over the detention legality (arrest, preventive detention) and supervises execution of the judges’ orders (art.13 p.1 and 3 LP RM). Thereby, examined law corresponds to exigencies of p.3 of the Recommendation.
